Information We Collect and Security

We, Roquette Riddhi Siddhi Private Limited, are committed to provide excellent customer service and outstanding value to you while respecting and protecting the privacy of our customers. In order to serve you better, we may collect and maintain certain information regarding products, service preferences, billing and delivery information. Under no circumstances do we sell or rent this information to other businesses, and we protect and ensure the confidentiality of this information. We respect your privacy and seek to protect the trust you place in us. Our Privacy Policy is explained in more detail below.

Cookies

To personalize your experience, we may use a feature on your internet browser called a ‘Cookie’. Cookies are small files that your Web browser places on your device's hard drive. We use cookies to let us know that you are a prior customer and to retrieve certain information previously provided by you to us, so that you do not need to re-enter this information every time you place an order on us. Cookies are not used to access information entered on the secure server. This information can only be accessed when you enter your name and password. If you choose to configure your browser to remove or reject our cookies, you will not be able to make purchases from us.

Web Beacons

In addition, from time to time, we may contract with third party companies to help us better provide relevant products and services to you. Some of these companies use Web Beacons (also known as action tags or single pixel gifs). A Web Beacon is a transparent image that has been placed on a web page and sends a signal when a user has visited that page. A Web Beacon does not contain any personal information.

Use of Information Gathered

We and the third parties who provide services to us will use the information referenced above to fulfill your order and provide related services. Examples of these services include fraud protection and credit risk reduction, product customization, order fulfillment and delivery, web site evaluation, data analysis and, where applicable, data cleansing. The third parties who provide any of these services are authorized to use this information only in connection with the services they are engaged to perform.

In addition to using the information to fulfill your purchase order, we also retain some of that information in our customer database. We use that information to track your order, to respond to your inquiries and to make subsequent purchases you wish to make easier and faster. We also may use that information, from time to time, to contact you concerning products, services, sales or special promotions.

Unsolicited E-mail (SPAM)

Your privacy is very important to us. Be assured that, in accordance with our Privacy Policy, we do not sell or distribute our customer list to third parties. You should be aware, however, that unscrupulous marketers can sometimes 'harvest' your email address directly from your computer or another person's address book or even obtain your email address through programs that automatically search web pages and email traffic for email addresses.

Your Consent

By using our Mobile App “Roquette India” and/or site (www.roquette.co.in), you consent to the collection, use, and disclosure of information by us and to the terms of this privacy policy. If we ever change our privacy policy, we will post any changes on this page so that you are always aware of the information that we collect, how we use it, and under what circumstances we disclose it. If we were to make a material change to our privacy policy, we will either post a notice on our Mobile App “Roquette India” and/or at site (www.roquette.co.in) or send you an e-mail.

1. General

   www.roquette.co.in and Mobile App “Roquette India” (collectively referred to as "Online Portal") is owned and operated by Roquette Riddhi Siddhi Private Limited (“Roquette”), a company incorporated under the laws of India, with its registered office at 18th Floor, Shapath V, Near Karnavati Club, S. G. Highway, Ahmedabad - 380015, India. Use of the Online Portal is offered to you conditioned on acceptance of all the terms, conditions and notices contained in these Terms and Conditions of Use (“Terms”), along with any amendments made by Roquette at its sole discretion and posted on the Online Portal.

2. User Account, Password, and Security

   The Online Portal requires the registration as a user in order to purchase products from the Online Portal. You will receive a password and account designation upon the completion of the registration process by Roquette. You will be responsible for maintaining the confidentiality of the password and the account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Roquette of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Roquette cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.

3. Functionalities offered

   The Online Portal is a platform through which the orders are placed for the purchase of products offered by Roquette.

4. Privacy Policy

   You hereby consents, expresses and agrees that you have read and fully understood the Privacy Policy of Roquette in respect of the Online Portal. You further consent that the terms and contents of such Privacy Policy are acceptable to you.

5. User obligations

   You agree and undertake to use the Online Portal only to place orders for purchase of products offered by Roquette. By way of example, and not as a limitation, you agree and undertake that when using the Online Portal, you will:
   • not use the solution for threats, harassment or abuse, or more generally to violate the rights of third parties (including the right to privacy);Not Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, threatening, abusive, infringing, obscene, indecent, racist, enticement to discrimination, hatred or violence based on race, ethnicity or religion; nor any counterfeit content; information contrary to the good morals or in general, illicit or unlawful topic, name, material or information through any bookmark, open comments , tag or keyword;
   • Record in the system only those data and documents that are accurate and appropriate to the process, in accordance with current legislation (personal data, photographs, identity documents, etc.) and to keep them up-to-date;
   • Not falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
   • Not violate any code of conduct or other guidelines, as may be applicable;
   • Not violate any applicable laws or regulations for the time being in force in or outside India;
   • Not violate any of the terms and conditions of these Terms or any other terms and conditions for the use of the Online Portal contained elsewhere herein;
   • Not reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Online Portal;
   • Refrain from collecting, storing and / or disseminating any personal data of others without their authorization or to disseminate your personal data which is not subject to declared treatments;
   • not distribute or use computer programs containing destructive functionality (including, but not limited to, viruses, Trojan horse, other software or code harmful to the software or computers of others, etc.);
   • not commit identity theft against any other or other person, with and without the intent to deceive or injure others; and
   • not share personal and nominative login information with another USER or third party.
   Notwithstanding anything to contrary, you further agree that the liability provisions as mentioned under the “Terms and Conditions of Sale”, uploaded on the Online Portal, shall also apply to these Terms.

6. Usage Conduct

   1. You shall solely be responsible for maintaining the necessary equipment and Internet connections that may be required to access, use and transact on the Online Portal.
   2. You are also under an obligation to use the Online Portal for reasonable and lawful purposes only, and shall not indulge in any activity that is not envisaged through the Online Portal.

7. Intellectual Property Rights

   1. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Roquette owns or is the exclusive licensee of all intellectual property and like rights in and to the trademarks "Roquette" and the Online Portal, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Online Portal belonging to Roquette without obtaining authorization from Roquette.
   2. Notwithstanding the foregoing, it is expressly clarified that you will solely be responsible for any content that you provide when accessing the Online Portal, including any text, data, information, images, photographs, music, sound, video or any other material.

8. Links To Third Party Sites

   The Online Portal may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Roquette, and Roquette is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Roquette is not responsible for any form of transmission, whatsoever, received by you from any Linked Site. The Online Portal may provide links of online advertisements to you only as a convenience and the inclusion of any link neither imply endorsement by or affiliation with Roquette of the Linked Sites nor does it represent the advice, views, opinions or beliefs of Roquette. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information. In the event that by accessing the Online Portal or following links to third-party websites you are exposed to content that you consider offensive or inappropriate, your only recourse will be to stop using the Online Portal.

9. Disclaimer Of Warranties & Liability

   Roquette has endeavored to ensure that all the information on the Online Portal is correct, but it neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data, information, product or service. In no event shall Roquette be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages. Neither shall Roquette be responsible for the delay or inability to use the Online Portal or failure to provide for any information, software, products, and related graphics obtained through the Online Portal, or otherwise arising out of the use of the Online Portal, whether based on contract, tort, negligence, strict liability or otherwise. Further, Roquette shall not be held responsible for non-availability of the Online Portal during periodic maintenance operations or any unplanned suspension of access to the Online Portal that may occur due to technical reasons or for any reason beyond Roquette’s control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through the Online Portal is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

10. Indemnification

    You agree to indemnify, defend and hold harmless Roquette, together with its directors, officers, employees, agents and contractors, from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Roquette, its directors, officers, employees, agents and/or contractors that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms.

11. Force majeure

    The liability of Roquette shall not be engaged in case of force majeure or events beyond its control.

12. Termination

    1. Roquette may suspend or terminate your use of the Online Portal at its sole and absolute discretion.
    2. Notwithstanding the foregoing sub-section above, these Terms will survive indefinitely unless and until Roquette chooses to terminate them.
    3. If you terminate your use of the Online Portal, Roquette may delete any content or other materials relating to your use of the Online Portal and Roquette will have no liability to you or any third party for doing so.

13. Governing Law

    These terms shall be governed by and constructed in accordance with the laws of India and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Mumbai, India.
